How to adapt your website to the new guidelines for the use of cookies

What has happened with the European guidelines on the use of cookies approved in May 2020? Are companies complying with the regulations? If you have not done so yet, in this article you will find everything you need to know to adapt your website and comply with the regulations.

Guidelines 5/2020 introduced a number of new features in terms of cookie acceptance policy. In addition, they established new obligations for companies to obtain user consent.
We remind you of the most important points and how user information should be displayed to meet the requirement of informed consent.
Although the cookie usage regulations came into force more than a year ago , many websites have not yet adapted. Among other aspects, the most obvious is that most do not offer the option of rejecting the “famous” cookies .


Something simple to solve but, if not done, can lead to significant fines from an AEPD that is being very demanding with respect to compliance by SMEs. Another example of sanctions is found with the European Association for Privacy and Digital Rights (Noyb), an organisation that has recently filed more than 400 complaints against websites on the continent that were in breach of the GDPR by not offering the possibility of rejecting cookies .

What are cookies ?
As you know, these are pieces of data from a website hotels and motels email list that are stored on the device with which the user accesses the page. All companies familiar with the concept or that operate with websites are well aware of the objective: to offer content related to the interests of the Internet user.

However, following the review of the legal text on consent policy, carried out by the European Data Protection Committee (EDPC), a new regulation was developed that all companies must comply with: Guidelines 05/2020 . For this reason, and to harmonize the use of cookies with what Europe dictates, the AEPD updated the guide on the use of cookies.
